An Ordinance to make better provision for the maintenance

of Public Health in relation to Food.

BE it enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof, as follows:

1. This Ordinance may be cited as the Public Health Short title. (Food) Ordinance, 1953.

2. In this Ordinance,-

(1) "Bake-house' means any premises on which bread, biscuits or confectionery are baked for sale as food for man and includes any premises on which such food is prepared for baking or on which the materials for the preparation of such food are stored.

(2) "Colonial Veterinary Surgeon" includes any Veterin- ary Surgeon authorised by the Governor under this Ordinance and also any Assistant Veterinary Surgeon.

(3) "Council" means the Urban Council, unless some other Council is indicated.

(4) "Dairy" means and includes any farm-house, cowshed, milk-store, milk shop or other place from which milk is supplied or in which milk is kept for purposes of manufacture or sale.

(5) "Dairyman" includes any keeper of cows or buffaloes for the purpose of trade in milk, or purveyor of milk, or seller of milk, or occupier of a dairy and shall include the employees thereof engaged in the production, distribution or sale of milk and in cases where a dairy is owned by a corpora- tion or company includes the secretary or other person actually managing such dairy.

(6) "Eating House" means a building or portion thereof used as an eating house, coffee house or other similar establish- ment (where no intoxicating liquors are sold on the premises).

(7) "Food" includes every food or article used for food or drink other than drugs.

(8) "Food Officer" means any person appointed by the Board on the recommendation of the Director of Medical and Sanitary Services for the purposes of this Ordinance.

(9) "Food Factory" means a place where food is prepared for sale and includes bake-houses, food preserving establishments and aerated water manufacturies.

(10) Health Officer" includes the Director of Medical and Sanitary Services, any medical officer appointed as a Health Officer by the Governor, and any officer for the time being performing the duties of a Health Officer.
